This website is operated by l'Atelier de Création "Au Fil du Bonheur". Throughout the site, we use the terms "we", "us" and "our" in reference to l'Atelier de Création "Au Fil du Bonheur". This website, including all information, tools and services available on it, is offered by l'Atelier de Création "Au Fil du Bonheur" to you, the user, conditional on your acceptance of all the terms, conditions, policies and notices stated here.
Our shop is hosted on PrestaShop. This company provides us with the online e-commerce platform that allows us to sell our products and services to you.
ARTICLE 1 - GENERAL PROVISIONS
The e-commerce website of l'Atelier de Création "Au Fil du Bonheur", a natural person whose registered office is located at Chaussée de Waterloo 121, 1640 Rhode-Saint-Genèse, VAT BE(0)780218510, offers its customers the possibility of purchasing products from its online shop.
These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). Any Customer placing an order through the online shop of l'Atelier de Création "Au Fil du Bonheur" must expressly accept these Terms and Conditions and thereby consent to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been expressly accepted by us in writing in advance.
ARTICLE 2 - THE BUYER
The Buyer, in order to validly place an order on the Site, must be at least 18 (eighteen) years old and have legal capacity, or if he/she is not 18 (eighteen) years old, be the holder of a parental authorisation allowing him/her to place an order on the Site. The Buyer therefore declares that he/she has the capacity to enter into this contract and is not under guardianship. l'Atelier de Création "Au Fil du Bonheur" reserves the right to ask any Buyer to prove his/her age or parental authorisation, and not to honour the Buyer's order in the event that the latter does not provide proof. When the Buyer transmits to l'Atelier de Création "Au Fil du Bonheur", via the Site, his contact details necessary for the delivery and invoicing of the product(s) [as defined below], he must ensure the accuracy and completeness of the information he transmits. In the event of an error in the wording of the recipient's details, We shall not be held responsible for the impossibility of delivering the product(s) [as defined below] ordered. We reserve the right to cancel an order (cash on delivery) which is deemed not to meet the above conditions, without being held liable.
ARTICLE 3 - PRODUCTS
Despite the fact that the online catalogue and the e-commerce website are made with the greatest care, it is possible that the information provided is incomplete, contains material errors or is not up to date. L'Atelier de Création "Au Fil du Bonheur" is not responsible for any obvious mistakes or errors in the offer. With regard to the accuracy and completeness of the information provided, we are only bound by an obligation of means. We shall not be held liable in any way for obvious material, typographical or printing errors.
If the customer has specific questions about, for example, size, colour, availability or delivery time or method, he/she should contact our customer service department in advance.
The offer is valid while stocks last and may be adjusted or withdrawn by us at any time. We cannot be held responsible for the non-availability of a product. If an offer has a limited validity period or is made subject to conditions, this information is explicitly mentioned in the offer.
ARTICLE 4 - UNAVAILABILITY
In the event that, despite the vigilance of l'Atelier de Création "Au Fil du Bonheur", one or more products ordered by the Buyer are temporarily or permanently unavailable, we will inform the Buyer by email. The Buyer will then have the possibility of modifying or cancelling his order by email addressed to email@example.com at the latest within 15 (fifteen) working days after having been informed by us. If necessary, l'Atelier de Création "Au Fil du Bonheur" undertakes to modify the order or to reimburse the Buyer whose payment has already been debited within 15 (fifteen) days after the date of modification or cancellation of the order. No additional compensation will be paid by us to the Buyer. If the Buyer fails to react within 15 (fifteen) days, we will cancel all or part of the order and refund all or part of the amounts paid.
ARTICLE 5 - PRICES
All prices mentioned are expressed in EURO.
For shipments within the European Union, all prices include VAT.
For shipments outside the European Union (with the exception of the United States), prices do not include import duties and other customs charges, unless otherwise specified during the ordering process.
For shipments to the United States, import duties and all other customs charges have been included in the prices.
The exact shipping costs depend on the destination and the delivery method chosen. These will always be communicated to you separately during the payment process.
The price indication refers exclusively to the articles formulated word for word. The corresponding photos are included for illustrative purposes and may include elements that are not included in the price.
ARTICLE 6 - ONLINE SHOPPING & PAYMENT
The Customer may choose from the following payment methods:
L'Atelier de Création "Au Fil du Bonheur" accepts the following credit cards: American Express, Visa and MasterCard.
Your credit card details are not stored in our database. To guarantee a secure payment, l'Atelier de Création "Au Fil du Bonheur" works with Ingenico Payment which meets the highest security standards.
You have your e-mail address and your PayPal password. You can find more information on the Paypal website. Payments with PayPal are always free.
You can pay quickly, easily, online and securely via your own bank. Payments with Bancontact/Mister Cash are completely free.
If you have an IBAN bank account, you can also pay by bank transfer.
L'Atelier de Création "Au Fil du Bonheur" is entitled to refuse an order following a serious breach of duty by the Customer with regard to orders where the Customer in question is involved.
ARTICLE 7 - DELIVERY AND PERFORMANCE OF THE CONTRACT
L'Atelier de Création "Au Fil du Bonheur" delivers worldwide, from Monday to Friday. In Belgium, we also deliver on Saturdays.
The exact delivery time and shipping costs depend on the destination and the chosen delivery method. These will be confirmed to you when you place your order.
Once the parcel has been shipped, you can track it from your account or with the parcel code on the website of the chosen delivery company. You will find this code in the shipment confirmation.
Your order is tracked very closely. You will be informed immediately if any problems arise.
Unless explicitly agreed otherwise, the goods will be delivered to the customer's home within 30 days of receipt of the order.
Visible deterioration and/or quality defects of an item or any other shortcomings regarding the delivery must be reported to us immediately by the Customer.
The risk of loss or damage passes to the Customer from the moment he (or a third party appointed by him who is not the carrier) takes physical possession of the goods. However, risk passes to the Customer on delivery to the carrier if the Customer's carrier has been instructed to carry the goods and this option was not offered by us.
ARTICLE 8 - RESERVATION OF OWNERSHIP
The delivered articles remain the exclusive property of l'Atelier de Création "Au Fil du Bonheur" until the moment of full payment by the Customer.
The Customer undertakes, if necessary, to notify the reservation of ownership of l'Atelier de Création "Au Fil du Bonheur" to third parties, for example to anyone who may seize articles that have not yet been fully paid for.
ARTICLE 9 - RIGHT OF WITHDRAWAL
The provisions of this article shall apply exclusively to customers who purchase articles online from l'Atelier de Création "Au Fil du Bonheur" in their capacity as consumers

L'Atelier de Création "Au Fil du Bonheur" aims to satisfy the customer as much as possible.
Personalised articles cannot be returned.
ARTICLE 10 - GUARANTEE
Every consumer is entitled to a legal guarantee of 2 years as provided for in article VI.2. of book VI of the economic law code. The legal guarantee starts from the moment of delivery. Any problem must be reported in writing to the customer service department of l'Atelier de Création "Au Fil du Bonheur", Chaussée de Waterloo 121, 1640 Rhode-Saint-Genèse or by e-mail to firstname.lastname@example.org. We will organise the free collection of your items from your home.
To invoke the guarantee, the Customer must present proof of purchase. Customers are advised to keep the original packaging of the goods.

ARTICLE 12 - PENALTIES FOR NON-PAYMENT
Without prejudice to the exercise of other rights available to l'Atelier de Création "Au Fil du Bonheur", the Customer shall, in the event of non-payment or late payment, be liable by operation of law and without notice of default to pay interest of 10% per annum on the unpaid amount as from the date of non-performance. The Customer shall also be liable to pay, ipso jure and without notice of default, a fixed compensation of 10% of the amount concerned, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, We reserve the right to take back items that have not been paid for (in full).
ARTICLE 13 - PRIVACY
The person in charge of processing, l'Atelier de Création "Au Fil du Bonheur" respects the Belgian law of 8 December 1992 on the protection of privacy with regard to the processing of personal data.
The personal data communicated by you will be used exclusively for the following purposes
- the execution of the concluded contract, the processing of the order
- direct marketing purposes
In case of use of the data for direct marketing purposes: you can object to the use of your data for direct marketing purposes free of charge. You can contact us at any time for this purpose.
We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties.
The customer himself is responsible for the confidentiality of his login data and the use of his password. Your password is stored in encrypted form; l'Atelier de Création "Au Fil du Bonheur" therefore has no access to your password.
We use (anonymous) online visitor statistics to determine which pages of the website are visited and to what extent.

ARTICLE 16 - FORCE MAJEURE
The liability of l'Atelier de Création "Au Fil du Bonheur" shall not be incurred for total or partial non-compliance with the obligations of the present General Terms and Conditions in the event of the occurrence of an event of force majeure, i.e. an unforeseeable and insurmountable event occurring after the order which makes it impossible for l'Atelier de Création "Au Fil du Bonheur" to fulfil its obligations even though no fault can be attributed to it.
ARTICLE 17 - AFTER-SALES SERVICE
Complaints may be addressed to l'Atelier de Création "Au Fil du Bonheur" on the page [Need help? Contact us] of the Site or by e-mail to firstname.lastname@example.org. We will do our best to reply as soon as possible. Justified complaints do not give rise to any costs for the Buyer.
ARTICLE 18 - APPLICABLE LAW & JURISDICTION
These General Conditions are governed by Belgian law, regardless of the country of delivery, subject to the application of provisions that cannot be derogated from by agreement under the law of the country of the Buyer's usual residence. In the absence of an amicable agreement, which must be sought before any legal recourse, any dispute relating to the interpretation and/or execution of these General Conditions shall be referred to the competent courts pursuant to Regulation (EU) No. 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
